Welcome to BrigadaClth. By accessing, purchasing from, or using our website or services, you agree to the following Terms of Service (“Terms”). Please read them carefully. If you do not agree, do not use our platform.

1. General Use

By using the BrigadaClth website or making a purchase, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.

BrigadaClth reserves the right to update, change, or replace any part of these Terms at any time without notice. Continued use of the website constitutes acceptance of all updates.

2. Products & Availability

All items are produced in limited batches. Product descriptions, pricing, and availability may be updated at any time. We reserve the right to discontinue any product at our discretion.

3. Shipping & Fulfillment

Shipping times are estimates only.
Due to limited-run production, supply chain variability, and logistics processing, orders may take extended time to ship. Delivery may take 4–6 weeks or longer depending on operational circumstances.

By placing an order, you acknowledge and agree that:

• Shipping times are not guaranteed.

• Delays do not constitute grounds for cancellation, refund, or dispute.

• BrigadaClth is not liable for carrier delays, lost parcels after shipment, customs delays, or international transit issues.

4. No Refunds / No Returns / No Exchanges

All sales are final.

BrigadaClth does not offer refunds, returns, cancellations, or exchanges under any circumstances, including but not limited to:

• Wrong size ordered

• Change of mind

• Shipping delays

• Limited edition products selling out

• Lost or stolen packages after shipment

• Minor variations in color, printing, or materials inherent to manufacturing

By completing checkout, you accept that your purchase is final.

5. Limitation of Liability

To the fullest extent permitted by law:

• BrigadaClth, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

• BrigadaClth’s total liability for any claim shall not exceed the amount paid for the product in question, if any.

You agree that your sole and exclusive remedy for any dissatisfaction with the product or service is to stop using the site and to not purchase again.

6. Arbitration Agreement (No Court, No Class Actions)

By purchasing from BrigadaClth, you agree that any dispute, claim, or controversy arising out of your purchase or use of the website shall be resolved exclusively through binding arbitration, not through court litigation.

This means:

• No lawsuits

• No class actions

• No jury trials

Arbitration will take place individually and in accordance with the rules of the American Arbitration Association (AAA) or a similar recognized body.

7. Intellectual Property

All logos, designs, graphics, product names, and branding are owned by BrigadaClth. Unauthorized use, reproduction, or distribution is prohibited.

8. Indemnification

You agree to indemnify and hold harmless BrigadaClth and its affiliates from any claims, damages, losses, costs, or expenses (including legal fees) arising from your misuse of the website, violation of the Terms, or infringement of any rights.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
